Disqualification and Disclosure Procedures and Scenarios

Failing to disqualify from a case can be an appealable issue but also invokes Rule 2.11 of the ABA Model Code of Judicial Conduct. Judges face the difficult task of determining whether to disclose facts that may implicate a potential basis for disqualification. Judges also are prohibited from directly requesting waivers for conflicts. This session will explore the range of appropriate disclosures, mandatory disqualifying interests, and the role of judicial conduct commissions where there are both legal issues and conduct that requires discipline. Thursday, October 16th from 10:30 AM to 12:00 PM and Friday, October 17 from 8:30 AM - 10:00 AM
